Fitzgerald, Acting Commissioner of An Garda Sı́ochána, in exercise of the powers conferred on me by section 84 (as amended by section 6 of, and the schedule to, the Road Traffic Act 1968 (No. 25 of 1968)) of the Road Traffic Act 1961 (No. 24 of 1961) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 (S.I. No. 298 of 2002) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 (S.I. No. 305 of 2002)), with the consent of the Minister for Transport after consultation with Dublin City Council, the councils of the counties of South Dublin, Dun Laoghaire-Rathdown and Fingal, hereby make the following bye-laws in respect of the area comprising the city of Dublin and counties of South Dublin, Dun Laoghaire-Rathdown and Fingal. Citation. 1. These bye-laws may be cited as the Dublin Appointed Stands (Street Service Vehicles) Bye-Laws 2002. Interpretation. 2. (1) In these bye-laws— ‘‘building line’’ means in relation to a side of a street on which there is no straight line of buildings, the edge of that side of the street; ‘‘Schedule’’ means the Schedule to these bye-laws; ‘‘street’’ means a public road. (2) In these bye-laws— 18 IRIS OIFIGIÚIL, JANUARY 10th, 2003 (a) a reference to the head of an appointed stand shall be construed as a reference to that end of the appointed stand from which the limits of the appointed stand are reckoned in column (3) of the appropriate Schedule to these bye-laws; (b) a reference to the rear of an appointed stand shall be construed as a reference to that end of the appointed stand to which the limits of the appointed stand are reckoned in column (3) of Schedule 1, 2 or 3 as appropriate: (c) a reference to the order of street service vehicles at an appointed stand shall be construed as a reference to the order of the vehicles reckoned from the head of the appointed stand to the rear of the appointed stand. Appointment of appointed stands. 3. (1) Subject to these Bye-laws, in each location in column (2) of Schedule 1 to these bye-laws, each part of the street described in column (3) of that Schedule opposite the mention in column (2) of the location shall be an appointed stand available for use without limitation as to time or occasion of use. (2) Subject to these bye-laws, in each location in column (2) of Schedule 2 to these bye-laws, each part of the street described in column (3) of the Schedule shall be an appointed stand available for use on the occasions only and at the time specified in column (6) of that Schedule opposite the mention in column (2) of the street. Main and subsidiary appointed stands. 4. (1) For the purpose of these bye-laws (a) each of the appointed stands mentioned in column (2) of Schedule 3 to these bye-laws shall be known as a main appointed stand, (b) each of the appointed stands mentioned in column (3) of the said Schedule 3 shall be known as a subsidiary appointed stand. Position of vehicles on appointed stands. 5. (1) Every street vehicle standing for hire at an appointed stand shall be placed— (a) within the limits of the appointed stand described in column (3) of Schedule 1 or 2, as appropriate, (b) in the position specified in column (5) of Schedule 1 or 2, as appropriate, to these bye-laws opposite the mention of the appointed stand in column (3) of the Schedule concerned, and (c) in case there is no street service vehicle already at the appointed stand and, in any other case, next in order to the street service vehicle at the appointed stand and as near as practicable to the street service vehicle immediately in front. (2) A street service vehicle standing for hire at an appointed stand shall be placed in single line by the kerb and parallel to the kerb or with the rear of the vehicle to the kerb, a vehicle shall not be placed more than 45 centimeters from the kerb. (3) A street service vehicle shall be deemed for the purpose of these bye-laws not to be standing for hire at the appointed stand unless it complies with this bye-law. Maximum number of street service vehicles at an appointed stand. 6. The number of street service vehicles standing for hire at an appointed stand specified in column (3) of Schedule 1 or 2 at any reference shall not exceed the number specified in column (4) of that Schedule concerned at that reference number. Vacancies at appointed stands. 7. (1) Whenever a street service vehicle vacates its position at an appointed stand it shall be replaced by the street service vehicle (if any) next in order at the stand. (2) (a) Whenever a street service vehicle vacates its position at a main appointed stand, it shall be replaced by the street service vehicle (if any) at the head of the subsidiary appointed stand first referred to in column (3) of Schedule 3 opposite the mention in column (2) of that Schedule. (b) Where one or more subsidiary stands are referred to in column (3) of Schedule 3, the vacancy to which paragraph (a) relates shall be replaced by the street service vehicle (if any) at the head of the first subsidiary appointed stand so referred to in the Schedule. (3) Whenever a street service vehicle vacates its position at a subsidiary appointed stand, it shall be replaced by the street service vehicle (if any) at the head of the next subsidiary appointed stand referred to in column (3) of Schedule 3 opposite the mention in column (2) of that Schedule. General provisions relating to appointed stands. 8. The following provisions shall apply to street service vehicles standing for hire at an appointed stand— (a) a person shall not wash, overhaul or execute repairs to such a street service vehicle, except such repairs as may be necessary to enable the vehicle to be removed from the appointed stand; (b) neither the driver of such a street service vehicle nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine of any equipment, fittings or instruments fitted to or carried on the vehicle or any loud speaker in or in any way connected with the vehicle; (c) the driver of such a street service vehicle shall comply with any directions given to him or her by a member of the Garda Sı́ochána in relation to placing of the street service vehicle at the appointed stand or the bringing of the street service vehicle into, or the removal of the street service vehicle from, the appointed stand. General restrictions on street service vehicles standing for hire. 9. A driver of a street service vehicle shall not stand the street service vehicle for hire otherwise than at an appointed stand and in accordance with these bye-laws. Revocation. 10. The Dublin Appointed Stands (Street Service Vehicles) Bye-Laws 1986 (S.I. No. 104 of 1986) and the Dublin Appointed Stands (Street Service Vehicles) (Amendment) Bye-Laws, 1989 (S.I. 2003 S.I. No. 551 of 2002. THE DISEASES OF ANIMALS ACT (TRANSMISSIBLE SPONGIFORM ENCEPHALOPATHIES) (MEAT AND BONE MEAL AND POULTRY OFFAL) ORDER 2002. The Minister for Agriculture and Food has made an order, entitled as above which amends, consolidates and replaces a number of existing Orders controlling the manufacture, sale, purchase, feeding and storage of mammalian meat and bone meal and poultry offal. The Order also provides for additional controls on the labelling of pet feedingstuffs and introduces a ban on keeping dried pet feedingstuffs which contain mammalian meat and bone on farms; such feedingstuffs containing poultry offal is permitted on farms only if in bags weighing less than 5 kilos under specified conditions (tinned pet feedingstuffs are not affected by the new Order). The Order also specifies conditions relating to storage and transport (dedicated vehicles) of these products and provides for a ban on the use of mammalian meat and bone meal in fertiliser. This Order retains the existing ban on the feeding of these products to any animal intended for food consumption and is in addition to the controls on the ban on feeding processed animal proteins to farmed animals intended for the production of food in the European Communities (Processed Animal Products) Regulations, 2000 (S.I. No. 486 of 2000 refers). 2003 DEPARTMENT OF COMMUNICATIONS, MARINE AND NATURAL RESOURCES FISHERIES ACTS, 1959-2001 CONSERVATION OF SALMON AND SEA TROUT BYE-LAW No. 786, 2002 I, JOHN BROWNE, Minister of State at the Department of Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 9 (as amended by section 3 of the Fisheries (Amendment) Act 1962 (No. 31 of 1962)) of the Fisheries (Consolidation) Act 1959 (No. 14 of 1959), section 33 of the Fisheries (Amendment) Act 1962, the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order 1977 (S.I. No. 30 of 1977) (as adapted by the Marine (Alteration of Name of Department and Title of Minister) Order 2002 (S.I. No. 307 of 2002)) and the Communications, Marine and Natural Resources (Delegation of Ministerial Functions) Order 2002 (S.I. No. 374 of 2002), hereby make the following Bye-law: 1. This Bye-law may be cited as the Conservation of Salmon and Sea Trout Bye-law No. 786, 2002. 2. This Bye-law shall come into operation on 1 January 2003. 3. In this Bye-law— ‘‘salmon’’ means a fish of the species Salmo salar (Atlantic salmon); ‘‘sea trout’’ means the migratory form of Salmo trutta but does not include a sea trout which is 40 centimetres or less in length measured in a straight line from the tip of the snout to the fork of the tail. 4. Notwithstanding anything contained in any Bye-law prohibiting the taking or having possession of, more than a specified number of salmon or sea trout, a person shall not take by rod and line more than 20 fish (being either salmon or sea trout or any combination of both fish) in any year commencing on 1 January. 5. Subject to article 4 of this Bye-law, a person shall not take by rod and line on any day in any year commencing on 1 January— (a) more than one salmon or sea trout during the period from 1 January to 31 May, (b) more than three fish being either salmon or sea trout during the remainder of that year. 6. Any salmon or sea trout taken inadvertently in contravention of articles 4 or 5 of this Bye-law shall be handled carefully and returned without avoidable injury to the waters immediately upon being taken. 7. This Bye-law shall not affect the operation of any other Bye- law which prohibits the taking, or having in possession of, salmon or sea trout. 8. The Conservation of Salmon and Sea Trout Bye-law No. 781, 2001 is hereby revoked. GIVEN under my hand, 19 December, 2002. This Bye-law provides for a bag limit of 1 salmon or 1 sea trout per angler per day from 1 January to 31 May, and a bag limit of 3 fish (being either salmon or sea trout) per angler per day from 1 June to the end of the fishing season subject to a total allowable catch of 20 fish (being either salmon or sea trout or any combination of both fish) per year with effect from 1 January 2003. 2003 52 IRIS OIFIGIÚIL, JANUARY 17th, 2003 IMPLEMENTATION OF FLAT RATE INTERNET ACCESS CALL ORIGINATION — (FRIACO) The Commission for Communications Regulation (‘‘The Commission’’) published Decision Notice D1/03 entitled ‘‘Implementation of Flat Rate Internet Access Call Origination — (FRIACO)’’. The Commission Under the European Communities (Interconnection in Telecommunication) Regulations 1998, S.I. No. 15 of 1998 instructed eircom to implement the following directions: Direction 3.1 The Commission for Communications Regulation directs that the frozen product description for FRIACO (Flat Rate Internet Access Call Origination) in phase 1 be as published in Annex 1 to this Decision Notice. Direction 3.2 The Commission for Communications Regulation directs that eircom, using the frozen product description (published as Annex 1 to this Decision Notice), develop with the requesting OLOs involvement, an Inter-Operator Process Manual. The Commission for Communications Regulation directs that eircom conclude and submit the Inter-Operator Process Manual to the Commission for Communications Regulation no later than close of business on the 3rd February, 2003. Direction 3.4.2 The Commission for Communications Regulation directs that eircom provide to the Commission a fully cost oriented pricing submission, with full justification for appropriate FRIACO process elements for the FRIACO product as described in Direction 3.1 herein, no later than close of business on 12th February, 2003. Direction 3.5.1 The Commission for Communications Regulation directs that eircom submit a draft Reference Interconnect Offer Service Schedule for the FRIACO Product as described in Direction 3.1 herein no later than close of business on the 20th February, 2003. Direction 3.7.1 The Commission for Communications Regulation directs eircom to amend its Interconnection forecasting regime to state that all orders for required initial capacity for a FRIACO Product (as described in Direction 3.1 herein) be submitted no later than close of business on 12th March, 2003 and furthermore, to replace the current Interconnection forecasting regime, to the new forecasting regime (as described in Direction 3.2 herein) until 27th June, 2004 to enable operators to be in a position to meet the demands from users. Direction 3.7.2 The Commission for Communications Regulation directs eircom to amend its RIO to incorporate a delivery date of 27th June, 2003 for all requested transmission capacity and switch ports for the FRIACO product (as described in Direction 3.1 herein) submitted prior to close of business on 12th March, 2003 excepting only where a transmission or switching equipment availability constraint exists. Direction 3.7.3 Where eircom identify network constraints they must submit appropriate documentation of these constraints to the Commission for Communications Regulation, which the Commission for Communications Regulation will review and determine whether these constraints are legitimate for the delay of provision. Eircom must submit the documentation outlining the details of any constraints by close of business on 26th March, 2003, together with information as to how and when they could be overcome. Direction 3.8 The Commission for Communications Regulation directs that eircom amend its RIO to provide that any circuits and necessary product elements for the FRIACO product (as described in Direction 3.1 herein) ordered prior to close of business on the 12th March, 2003 will not be charged for until all circuits and necessary product elements contained within the OLO orders have been delivered by eircom excepting only those which are constrained as described in direction 3.7.2.
